The short version
- Naya gives general guidance and helps you keep track of your baby’s care. It does not diagnose, treat or replace a doctor, nurse or pharmacist.
- If your baby seems very unwell, go to a hospital or clinic straight away.
- You must be 18 or over, and the parent or guardian of any baby you add, or have their permission.
- What you add to Naya stays yours. You can delete it whenever you like.
1About these terms
These Terms of Service (“Terms”) apply to your use of the Naya website at asknaya.africa, the Naya web and mobile apps, and any related services (together, “Naya”). Naya is operated by [legal entity name], a company registered in Nigeria under RC number [RC number] (“Naya”, “we”, “us”).
By creating an account or using Naya, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use Naya.
2Naya is not medical advice
In an emergency, do not wait for Naya. If your baby has trouble breathing, a seizure, is very hard to wake, is under 3 months with a fever, or you are worried for any reason, go to the nearest hospital or clinic now.
Naya provides general information about baby care and development for babies aged 0 to 24 months. It is designed to help you understand your baby and decide when to seek care. It is not a medical service, and:
- it does not diagnose conditions, prescribe medicines or recommend doses for your individual baby;
- it cannot examine your baby, and may not know everything that matters about their health;
- it does not replace a consultation with a qualified health professional.
Always follow the advice of your doctor, nurse, midwife or pharmacist, even if it differs from something Naya says. Never delay seeking care, or ignore professional advice, because of something you read in Naya.
Naya may mention traditional or home remedies so you can understand them. This does not mean we recommend them. Some remedies can be harmful to babies, so check with a health professional before giving your baby anything.
3Who can use Naya
To use Naya you must:
- be at least 18 years old;
- be the parent or legal guardian of any baby you add, or have the permission of their parent or guardian;
- be able to enter into a binding agreement; and
- use Naya for your own family’s care, not for commercial or clinical purposes.
Naya is not designed for use by health facilities as a clinical tool or medical record system.
4Your account
- Give accurate information when you sign up, and keep it up to date. Naya’s guidance depends on details such as your baby’s date of birth being correct.
- Keep your login details private. You are responsible for activity on your account.
- Tell us straight away at hello@asknaya.africa if you think someone else has accessed your account.
- If you share your account or your baby’s profile with a partner or family member, you are responsible for who you share it with.
5AI answers
Naya’s replies are written with the help of artificial intelligence, based on reviewed baby-care content and the details in your baby’s profile. AI can make mistakes. An answer may be incomplete, out of date, or wrong for your baby’s situation, even when it sounds confident.
Use Naya’s answers as a starting point, check sources where they are shown, and speak to a health professional before making decisions about your baby’s health. If an answer seems wrong or unsafe, please report it in the app so we can review it.
6Your baby’s record
Naya keeps what you tell it. Your baby’s record in Naya is a personal record you keep for yourself. It is not an official medical record from a hospital or clinic, and a reaction you report is not the same as a confirmed allergy or diagnosis.
Keep the official documents your health facility gives you, such as your baby’s immunisation card. We work hard to keep your records safe and available, but we cannot guarantee they will never be lost, so please don’t rely on Naya as your only copy of important information.
7Your content
You own the information, notes and photos you add to Naya (“your content”). You give us permission to store, process and display your content only as needed to provide Naya to you, keep it safe, and improve it as described in our Privacy Policy. This permission ends when you delete your content or your account, except for copies we must keep by law.
Only add content you have the right to share. Do not add information about other adults without their permission.
8Using Naya fairly
Please do not:
- use Naya in a way that breaks the law or harms a child or anyone else;
- pretend to be someone else, or add a baby you have no right to care for;
- try to access other people’s accounts or data, or get around our security;
- copy, scrape, resell or build a competing product from Naya or its content;
- overload, disrupt or reverse engineer Naya, or introduce malware;
- try to make Naya produce harmful, abusive or misleading content.
9Fees
Naya is currently free to use. [confirm] If we introduce paid features, we will show the price, what it includes and how to cancel before you pay. We will never charge you without your clear agreement.
10Our content
The Naya name, logo, app, website, design and guidance content belong to us or our licensors and are protected by intellectual property laws. We give you a personal, non-transferable licence to use Naya for your own family’s care. You may share answers with your family and health workers, but you may not republish or sell our content.
11Changes and availability
We are always improving Naya, so features may change. We try to keep Naya available at all times, but it may sometimes be unavailable for maintenance or reasons beyond our control, such as network outages.
We may update these Terms. If a change is significant, we will tell you in the app or by message at least 14 days before it takes effect. If you keep using Naya after that, you accept the new Terms. If you don’t agree, you can delete your account.
12Ending your use
You can stop using Naya and delete your account at any time in Settings. You can download your baby’s record before you do.
We may suspend or close your account if you seriously or repeatedly break these Terms, or if we must do so by law. Where possible, we will tell you why and give you a chance to download your data first.
13Liability
We provide Naya with reasonable care and skill. Beyond that, and to the extent the law allows, Naya is provided “as is”, and we do not promise that it will be error-free or meet every need.
To the extent the law allows, we are not responsible for:
- decisions about your baby’s health made without consulting a qualified health professional;
- loss or harm that was not reasonably foreseeable;
- problems caused by your device, internet connection, or third-party services such as WhatsApp;
- loss caused by someone using your login details because you did not keep them safe.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. Nothing in these Terms affects your rights as a consumer under the Federal Competition and Consumer Protection Act 2018 or other consumer laws that apply to you.
14Law and disputes
These Terms are governed by the laws of the Federal Republic of Nigeria. If you have a complaint, please contact us first. We aim to resolve complaints within 30 days.
If we cannot resolve it together, either of us may refer the dispute to mediation at the Lagos Multi-Door Courthouse before going to court. Otherwise, the courts of Lagos State, Nigeria, will have jurisdiction. If you live outside Nigeria, you may also have the right to bring a claim in your own country.
